1. ABOUT US StayVacationRentals ("Platform", "we", "us", "our") is an online vacation rental marketplace operated by RM E Services Pvt Ltd, registered under the laws of India. We connect property owners ("Owners") with travellers ("Guests") seeking short-term vacation rentals worldwide.
2. ACCEPTANCE OF TERMS By accessing or using StayVacationRentals, you agree to be bound by these Terms. If you do not agree, do not use the Platform. These Terms apply to all users including Guests, Owners, and platform staff.
3. PLATFORM ROLE StayVacationRentals is a technology platform and marketplace only. We are not a party to any rental agreement between a Guest and an Owner. We do not own, manage, or operate any listed property. All rental agreements are directly between the Guest and the Owner.
4. GUEST TERMS
4.1 Eligibility: You must be at least 18 years old to make a booking.
4.2 Bookings: All bookings are subject to Owner approval. A booking is confirmed only upon receipt of full or partial payment as specified and a confirmation message from the Platform.
4.3 Accuracy of Information: Guests must provide accurate personal information at the time of booking. False information may result in cancellation without refund.
4.4 Conduct: Guests agree to treat the property with care, comply with house rules set by the Owner, and not engage in any illegal activity on the premises. Any damage caused during the stay is the Guest's financial responsibility.
4.5 Cancellations and Refunds: Cancellations are subject to the cancellation policy displayed at the time of booking. StayVacationRentals' role is limited to facilitating the refund process; the final refund amount is determined by the applicable cancellation policy.
4.6 Disputes with Owners: Any dispute regarding property condition, amenities, or stay experience is between the Guest and the Owner. StayVacationRentals may assist in mediation at its discretion but is not liable for the outcome.
5. OWNER TERMS
5.1 Eligibility: Owners must have the legal right to list and rent the property. By listing, you confirm you hold all necessary permissions, licences, and approvals required under local law.
5.2 Accuracy of Listings: Owners are solely responsible for the accuracy of property descriptions, photos, pricing, availability, and house rules. Misleading listings may result in suspension or removal.
5.3 Guest Relations: Owners are responsible for honouring confirmed bookings, providing a safe and habitable property, and resolving Guest complaints in good faith.
5.4 Taxes and Compliance: Owners are solely responsible for collecting and remitting any applicable taxes (GST, local levies, tourism taxes) as required by law. StayVacationRentals does not collect or remit taxes on behalf of Owners.
5.5 Subscription and Fees: Access to Owner dashboard features is subject to the applicable subscription plan. Subscription fees are non-refundable except as stated in our Refund Policy.
5.6 Cancellations by Owners: Owners who cancel confirmed bookings may be subject to penalties including suspension of listing. Repeated cancellations may result in permanent removal from the Platform.
6. PAYMENTS
6.1 All payments processed through the Platform are subject to our Payment Policy.
6.2 StayVacationRentals uses third-party payment gateways. We are not responsible for payment failures, delays, or errors caused by third-party processors.
6.3 In case of a disputed transaction, the user must raise a complaint within 7 days of the transaction date.
7. INTELLECTUAL PROPERTY All content on the Platform including logos, design, code, and text is the property of StayVacationRentals. Users may not copy, reproduce, or distribute any content without prior written permission.
8. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law, StayVacationRentals shall not be liable for:
Any personal injury, property damage, or loss arising from a stay
Any dispute between a Guest and an Owner
Any inaccuracy in a property listing
Any interruption or unavailability of the Platform
Any indirect, incidental, or consequential damages
Our maximum aggregate liability to any user shall not exceed the total fees paid by that user to the Platform in the 3 months preceding the claim.
9. INDEMNIFICATION You agree to indemnify and hold harmless StayVacationRentals, its directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your interaction with another user.
10. PRIVACY Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. MODIFICATIONS We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify users of material changes by email or in-platform notification.
12. TERMINATION We reserve the right to suspend or terminate any user account at our discretion, including for violation of these Terms, fraudulent activity, or conduct harmful to other users or the Platform.
13. GOVERNING LAW AND DISPUTE RESOLUTION
13.1 These Terms shall be governed by and construed in accordance with the laws of India.
13.2 Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall first be attempted to be resolved through good faith negotiation between the parties.
13.3 If negotiation fails, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be conducted by a sole arbitrator mutually agreed upon by the parties. The seat and venue of arbitration shall be New Delhi, India.
13.4 Notwithstanding the above, either party may seek urgent interim relief from the courts of New Delhi.
13.5 Subject to the arbitration clause above, the courts of New Delhi, India shall have exclusive jurisdiction over any matter arising from these Terms.
